Terms of Service

1. Acceptance of Terms

By accessing or using the Drive Mart platform ("the Platform", "Drive Mart") at drivemart.co.uk, you agree to be bound by these Terms of Service ("Terms") in full. If you do not agree to these Terms in their entirety, you must not use the Platform and must leave immediately.

These Terms apply to all users without exception, including private buyers, private sellers, trade dealers, vehicle hirers, hire operators, auction sellers, auction bidders, and visitors. These Terms constitute a legally binding agreement between you and Colin Fairnie trading as Reliant Technologies, the operator of the Platform. By using the Platform you confirm you have read, understood, and accepted these Terms.

2. Legal Identity of the Operator — Drive Mart is a Platform Name Only

"Drive Mart" is a trading platform name only. It is not a registered company, legal entity, or incorporated body. The Platform is owned, operated, and provided exclusively by Colin Fairnie trading as Reliant Technologies, whose registered business address is 25 Delta Drive, Musselburgh, East Lothian, EH21 8HY, United Kingdom. All references in these Terms to "Drive Mart", "the Platform", "we", "us", or "our" refer solely to Colin Fairnie trading as Reliant Technologies. The name "Drive Mart" is used as a platform brand name only and confers no separate legal identity, corporate status, or liability on any entity other than Colin Fairnie trading as Reliant Technologies.

Colin Fairnie trading as Reliant Technologies is a sole trader and is not a limited company, partnership, or incorporated entity. Nothing in these Terms, and nothing in the use of the Drive Mart platform name, shall be construed as creating any liability on the part of any entity other than Colin Fairnie trading as Reliant Technologies, and even then only to the strictly limited extent set out in these Terms.

DRIVE MART IS A PLATFORM NAME ONLY. IT IS A TECHNOLOGY PLATFORM PROVIDED TO ENABLE USERS TO BUY, SELL, HIRE, AND AUCTION VEHICLES AND EQUIPMENT. ALL RESPONSIBILITY FOR EVERY TRANSACTION, AGREEMENT, HIRE, RENTAL, AUCTION, AND ACTIVITY CONDUCTED THROUGH THE PLATFORM RESTS ENTIRELY AND EXCLUSIVELY WITH THE BUYERS, SELLERS, HIRERS, HIRE OPERATORS, BIDDERS, AND OTHER USERS WHO ARE PARTIES TO THOSE TRANSACTIONS. COLIN FAIRNIE TRADING AS RELIANT TECHNOLOGIES HAS NO LIABILITY WHATSOEVER IN CONNECTION WITH ANY SUCH TRANSACTION OR ACTIVITY, SAVE ONLY AS EXPRESSLY AND STRICTLY PROVIDED IN CLAUSE 14.3 OF THESE TERMS.

3. The Nature of Drive Mart — Technology Platform Only

Drive Mart is, and at all times remains, solely an online technology platform and classified advertising marketplace. Drive Mart provides software tools that allow users to post vehicle listings, hire listings, and auction listings, and to communicate with other users. Drive Mart does not facilitate, arrange, or participate in any transaction between users.

DRIVE MART IS NOT, AND DOES NOT ACT AS, ANY OF THE FOLLOWING in connection with any listing, transaction, auction, hire, or rental conducted through the Platform: (a) a seller, buyer, dealer, or trader of vehicles or equipment; (b) a hire operator, rental company, or fleet operator; (c) an auctioneer, auction house, or licensed auctioneer under the Auctioneers Act 1845 or any other legislation; (d) an agent, broker, intermediary, or representative of any user; (e) a finance provider, credit broker, or FCA-authorised firm; (f) an insurer or insurance intermediary; (g) an escrow agent or payment intermediary for user-to-user transactions; (h) a vehicle inspector, surveyor, or assessor; (i) a guarantor of any transaction, listing, or user.

Drive Mart does not own, possess, inspect, test, insure, or take title to any vehicle or equipment listed on the Platform at any time. Drive Mart does not verify the accuracy of any listing, the identity of any user beyond basic account registration, or the legal status, roadworthiness, or existence of any vehicle or equipment.

All transactions of every kind — including sales, purchases, auctions, hire agreements, and rental agreements — are conducted solely and exclusively between the relevant users. Drive Mart is not a party to any such transaction or agreement and has no obligations, duties, or liabilities arising from them. All responsibility for every such transaction rests entirely with the parties to that transaction.

5. User Accounts

To list vehicles, place bids, or submit hire enquiries, you must create an account and verify your email address. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to use the Platform. You agree to provide accurate, current, and complete information when creating your account and to update it promptly if it changes.

Drive Mart reserves the right to suspend or terminate accounts that breach these Terms, without notice and without liability. Drive Mart is not responsible for any loss arising from unauthorised access to your account.

6. Seller Obligations & Sole Responsibility

Sellers are solely and exclusively responsible for all aspects of their listings and any resulting transactions. This includes without limitation: (a) the accuracy, completeness, and truthfulness of every listing; (b) ensuring the vehicle exists and precisely matches the description, photos, and specification provided; (c) disclosing all known faults, defects, accident history, outstanding finance, mileage discrepancies, category write-off status, and any other material information; (d) ensuring they own the vehicle outright or have clear legal authority to sell it free of encumbrance; (e) complying with the Consumer Protection from Unfair Trading Regulations 2008, the Consumer Rights Act 2015, the Fraud Act 2006, the Road Traffic Act 1988, and all other applicable UK law; (f) ensuring the vehicle is roadworthy and legally compliant at the point of sale where applicable; (g) paying all applicable taxes on proceeds of sale including income tax and VAT where applicable; (h) completing any agreed sale promptly and honestly.

Drive Mart bears no responsibility whatsoever for any inaccuracy, omission, or misrepresentation in a seller's listing. Listing fees are non-refundable once a listing is published and live. Drive Mart reserves the right to remove any listing at its sole discretion without refund and without liability.

7. Buyer Obligations & Sole Responsibility

Buyers are solely and exclusively responsible for all aspects of their purchase decisions and any resulting transactions. This includes without limitation: (a) conducting thorough independent due diligence before purchasing any vehicle; (b) physically inspecting the vehicle in person before making any payment whatsoever; (c) carrying out an independent HPI check to verify the vehicle's history, outstanding finance, stolen status, and write-off category; (d) verifying the seller's identity, address, and that the V5C logbook matches the vehicle, VIN, and seller; (e) satisfying themselves entirely as to the vehicle's condition, roadworthiness, mechanical integrity, and legal status; (f) ensuring they hold the appropriate driving licence category for the vehicle; (g) arranging appropriate motor insurance before driving the vehicle; (h) completing any agreed purchase promptly and honestly.

Drive Mart strongly advises buyers never to pay any deposit, holding fee, or purchase price without first inspecting the vehicle in person at the seller's genuine address. Drive Mart is not responsible for the condition, roadworthiness, legal status, or existence of any vehicle listed on the Platform. Drive Mart is not responsible for any loss, damage, injury, or death arising from a vehicle purchased through the Platform.

8. Hire Operator Obligations & Sole Responsibility

Hire operators (those listing vehicles for hire or rental) are solely and exclusively responsible for all aspects of their hire listings and any resulting hire agreements. This includes without limitation: (a) ensuring all vehicles listed for hire are roadworthy, mechanically sound, legally compliant, and hold a valid MOT where required; (b) ensuring all vehicles are properly insured for hire and reward use under a valid motor insurance policy; (c) ensuring all employed drivers hold the appropriate licence category (Category D for coaches, Category D1 for minibuses used for hire or reward, Category C for HGVs, and any other applicable category); (d) holding all necessary operator licences, PSV licences, O-licences, and any other licences required by law; (e) complying with the Road Traffic Act 1988, the Public Passenger Vehicles Act 1981, the Transport Act 1985, and all other applicable legislation; (f) ensuring comprehensive hire agreements, terms and conditions, and insurance arrangements are in place with hirers before any vehicle is handed over; (g) accurately describing vehicles, seating capacity, included features, driver qualifications, and pricing; (h) paying all applicable taxes on hire revenue.

Drive Mart is not a party to any hire agreement and accepts no responsibility whatsoever for any aspect of the hire transaction, the vehicle's condition, or any loss, injury, or damage arising from the hire.

9. Hirer & Renter Obligations & Sole Responsibility

Hirers and renters (those hiring or renting vehicles through the Platform) are solely and exclusively responsible for all aspects of their hire or rental. This includes without limitation: (a) ensuring they hold the appropriate driving licence category for the vehicle being hired; (b) ensuring they meet any minimum age, experience, or endorsement requirements set by the hire operator; (c) arranging appropriate motor insurance if not included in the hire agreement; (d) reading, understanding, and complying with all terms and conditions set by the hire operator before signing any agreement; (e) inspecting the vehicle at collection and noting any pre-existing damage before accepting it; (f) returning the vehicle in the condition in which it was received, subject to fair wear and tear; (g) paying all hire charges, deposits, fuel costs, and any damage costs as agreed with the hire operator; (h) complying with all applicable road traffic law, speed limits, and vehicle restrictions during the hire period.

Drive Mart is not a party to any hire agreement and accepts no responsibility whatsoever for any dispute between a hirer and a hire operator, or for any loss, injury, or damage arising during or after a hire.

10. Auction Listings — Full Terms

These auction terms apply to all vehicle auction listings posted on the Drive Mart platform. By creating an auction listing or placing a bid, you agree to be bound by these terms in full in addition to the general Terms of Service.

9.1 DRIVE MART'S ROLE IN AUCTIONS Drive Mart provides technology infrastructure that enables sellers to list vehicles for auction and registered users to place bids. Drive Mart is NOT an auctioneer, licensed auctioneer, agent, broker, or principal in any auction. Drive Mart does not own, inspect, or take title to any vehicle listed for auction. Drive Mart is not a party to any contract formed between a seller and a buyer through an auction. Drive Mart accepts no responsibility whatsoever for the conduct, outcome, or completion of any auction or any transaction arising from it. This is an absolute exclusion of liability.

9.2 SELLER'S ABSOLUTE RIGHT TO END OR CANCEL AN AUCTION The seller retains the absolute and unconditional right to end or cancel their auction at any time and for any reason, including but not limited to: (a) the vehicle being sold through another channel; (b) a change of mind; (c) a vehicle defect or issue discovered after listing; (d) a dispute regarding the vehicle's title or ownership; (e) any personal, commercial, or legal reason the seller deems sufficient; or (f) no reason at all. The seller may exercise this right by using the "End Auction & Accept Highest Bid" function to accept the current highest bid, or the "Cancel Auction" function to end the auction without accepting any bid.

Drive Mart shall have no liability whatsoever to any bidder, prospective buyer, or third party arising from a seller's decision to end or cancel an auction at any time and for any reason. No claim of any kind — including for wasted costs, loss of bargain, loss of profit, or any other loss — may be made against Drive Mart by any bidder or third party as a result of an auction being ended or cancelled by the seller. Bidders expressly acknowledge and accept this risk as a condition of placing any bid.

9.3 NO OBLIGATION ON SELLER TO SELL BELOW RESERVE Where a seller has set a reserve price, the seller is under no obligation to sell the vehicle if the reserve price has not been met at the time the auction ends, regardless of the number of bids placed or the level of the highest bid. The seller may, at their sole discretion, choose to accept a bid below the reserve price, but this is entirely voluntary and creates no precedent or obligation.

9.4 BINDING NATURE OF BIDS A bid placed by a registered user constitutes a legally binding offer to purchase the vehicle at the bid price, subject to the reserve price being met and the auction concluding without cancellation by the seller. By placing a bid, the bidder confirms they have the funds immediately available to complete the purchase and genuinely intend to do so if their bid is accepted. Bids may not be retracted once placed except in exceptional circumstances at Drive Mart's sole discretion. Drive Mart's decision on any retraction request is final and not subject to appeal.

9.5 BIDDER ELIGIBILITY AND IDENTITY VERIFICATION Only registered, verified account holders may place bids. By registering and bidding, you confirm that: (a) you are at least 18 years of age; (b) all information provided on your account is accurate, complete, and current; (c) you are bidding in your own name and on your own behalf; (d) you are not the seller of the vehicle being auctioned; (e) you are not acting as an agent, nominee, or associate of the seller or any connected party. Drive Mart records the identity, email address, and contact details of every registered bidder. This information is made available to the seller to facilitate completion of the transaction. Bidders expressly consent to their contact details being shared with the seller for this purpose by placing any bid.

9.6 SHILL BIDDING AND AUCTION MANIPULATION Shill bidding — the practice of placing bids on your own auction, or arranging for connected parties to place bids to artificially inflate the price — is strictly prohibited and may constitute a criminal offence under the Fraud Act 2006 and the Consumer Protection from Unfair Trading Regulations 2008. Drive Mart employs technical measures to detect and prevent shill bidding. Sellers are technically prevented from bidding on their own auctions. Any user found to have engaged in shill bidding or any other form of auction manipulation will have their account permanently suspended and will be reported to Action Fraud and relevant law enforcement authorities.

9.7 COMPLETION OF TRANSACTION Where an auction concludes with a winning bid at or above the reserve price, or where the seller elects to accept the highest bid, the seller and winning bidder are each solely and exclusively responsible for completing the transaction between themselves. Drive Mart is not responsible for facilitating, guaranteeing, or enforcing completion of any transaction. Drive Mart is not responsible for any failure by either party to complete the transaction. Drive Mart is not responsible for any loss arising from a failure to complete. Drive Mart strongly recommends that both parties: (a) communicate promptly following auction close; (b) arrange an in-person inspection before any payment is made; (c) use bank transfer (Faster Payments or CHAPS) for payment; (d) verify the V5C logbook, HPI status, and seller identity before completing the purchase.

9.8 AUCTION FEES Auction listing fees are charged to the seller at the time of listing and are non-refundable once the auction is live, regardless of whether the auction is ended early, cancelled by the seller, cancelled by Drive Mart, or results in no sale. Auction fees are paid to Drive Mart for the provision of the auction listing technology only and do not constitute any guarantee of sale, any warranty as to the vehicle's condition, or any obligation on Drive Mart to intervene in, enforce, or facilitate any transaction.

9.9 DRIVE MART'S RIGHT TO CANCEL AUCTIONS Drive Mart reserves the right to cancel, suspend, or remove any auction listing at any time and at its sole discretion, including but not limited to cases of: suspected fraud; suspected shill bidding; a listing that breaches these Terms; a vehicle reported as stolen; a vehicle subject to undisclosed outstanding finance; or any technical error affecting the integrity of the auction. Drive Mart shall have no liability whatsoever to the seller or any bidder arising from the exercise of this right.

9.10 NO WARRANTIES IN RELATION TO AUCTIONS Drive Mart makes no warranty, representation, or guarantee of any kind in relation to any auction listing, including as to the accuracy of the vehicle description, the seller's title to the vehicle, the vehicle's condition or roadworthiness, the identity of the seller, or the outcome of any auction. All bidders participate entirely at their own risk. Drive Mart's liability in connection with any auction is excluded to the maximum extent permitted by applicable law and in any event shall not exceed the auction listing fee paid by the seller.

10A. Auction — Seller Summary (Plain English)

For clarity, here is a plain-English summary of your key rights and obligations as a seller using Drive Mart auctions. This summary does not replace the full legal terms in Section 9 above.

YOU CAN: End your auction at any time for any reason using the "Cancel Auction" button. You are not required to give a reason. Drive Mart will not penalise you for cancelling and has no liability to bidders as a result of your cancellation.

YOU CAN: Accept the highest bid early at any time using the "End Auction & Accept Highest Bid" button, even before the scheduled end time.

YOU ARE NOT OBLIGED TO SELL if the reserve price has not been met when the auction ends.

YOU ARE RESPONSIBLE for completing the sale with the winning bidder if you accept their bid. Drive Mart is not involved in the transaction after the auction closes.

YOUR LISTING FEE IS NON-REFUNDABLE once the auction is live, regardless of the outcome.

YOU MUST NOT place bids on your own auction or arrange for others to do so on your behalf.

11. Trade Sellers

If you are a trade seller (a business selling vehicles in the course of a trade), you must clearly identify yourself as a trade seller on your profile and all listings. Trade sellers must comply with the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013, the Consumer Protection from Unfair Trading Regulations 2008, and all applicable FCA regulations if offering finance. Trade sellers are solely responsible for ensuring vehicles meet roadworthy standards and all relevant legal requirements before sale. Trade sellers must hold all necessary licences and comply with all applicable trading standards requirements. Drive Mart is not responsible for any failure by a trade seller to comply with their legal obligations.

12. Prohibited Conduct

You may not use the Platform to: list stolen vehicles; list vehicles with undisclosed outstanding finance; list clocked or mileage-tampered vehicles; list vehicles that do not exist or that you do not have authority to sell; misrepresent a vehicle's condition, history, specification, or ownership; conduct fraudulent transactions of any kind; harass, threaten, or abuse other users; engage in shill bidding or any form of auction manipulation; circumvent our fee structure; scrape, copy, or republish Platform data; or engage in any activity that violates UK law or these Terms.

Misrepresentation of a vehicle's condition or history may constitute a criminal offence under the Fraud Act 2006. Listing a stolen vehicle may constitute handling stolen goods under the Theft Act 1968. Drive Mart will cooperate fully with law enforcement investigations and will report suspected fraud to Action Fraud and the relevant authorities without notice to the user concerned.

13. Payments & Listing Fees

Listing fees are processed securely via Stripe. Drive Mart does not store payment card details. All listing fees are non-refundable once a listing is published and live, regardless of the outcome of any transaction or the removal of a listing for any reason.

Transactions between buyers and sellers, or between hirers and hire operators, are conducted directly between those parties. Drive Mart does not hold, process, or transmit any funds between users in connection with vehicle transactions. Drive Mart is not responsible for payment disputes between users.

We recommend using bank transfer (Faster Payments or CHAPS) for private sales and obtaining a receipt for all transactions. Be aware of scams — Drive Mart will never ask you to pay via cryptocurrency, gift cards, or wire transfer to a third party. Drive Mart is not responsible for any fraudulent payment requests made by third parties posing as Drive Mart or as other users.

14. No Warranties — Platform Provided "As Is"

Drive Mart provides the Platform "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.

Drive Mart does not warrant that: the Platform will be uninterrupted, error-free, or free from viruses or other harmful components; any listing is accurate, complete, or truthful; any user is who they claim to be; any vehicle is as described; any transaction will be completed; or the Platform will meet your requirements.

All reliance on information on the Platform is entirely at the user's own risk.

16. Indemnity

You agree to fully indemnify, defend, and hold harmless Colin Fairnie trading as Reliant Technologies and its contractors and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees on a solicitor-and-client basis) arising out of or relating to: (a) your use of the Platform in any way; (b) any listing you post, including any inaccuracy, omission, or misrepresentation therein; (c) any transaction, auction, hire, or rental you enter into through the Platform; (d) any auction you create, end, cancel, or withdraw; (e) any bid you place or fail to honour; (f) any hire agreement you enter into as operator or hirer; (g) your breach of these Terms or any applicable law or regulation; (h) any claim by a third party arising from your conduct on or through the Platform; (i) any personal injury, death, or property damage caused by a vehicle you listed, sold, auctioned, hired out, or rented out through the Platform.

17. Intellectual Property — Comprehensive Protection

17.1 OWNERSHIP All intellectual property rights in and to the Drive Mart platform, including without limitation the Drive Mart name, brand, logo, trade marks, service marks, trade dress, domain names (drivemart.co.uk, drivemart.uk, and all associated domains), website design, user interface, layout, colour scheme, typography, graphics, icons, software, source code, algorithms, databases, data structures, content, text, images, and all other materials on or forming part of the Platform ("Platform IP"), are owned by or exclusively licensed to Colin Fairnie trading as Reliant Technologies. All rights are reserved.

17.2 TRADE MARKS "Drive Mart", the Drive Mart logo, and all associated marks, names, and logos displayed on the Platform are trade marks or service marks of Colin Fairnie trading as Reliant Technologies (whether registered or unregistered). Nothing in these Terms grants you any right, licence, or interest in any trade mark, service mark, or logo of Colin Fairnie trading as Reliant Technologies. You must not use any Drive Mart trade mark or service mark in any way that is likely to cause confusion, that disparages or discredits Drive Mart, or that implies any association, endorsement, or sponsorship by Drive Mart without prior written consent.

17.3 COPYRIGHT The Platform and all content on it are protected by copyright under the Copyright, Designs and Patents Act 1988 and equivalent international laws. Copyright © 2024–2026 Colin Fairnie trading as Reliant Technologies. All rights reserved. Unauthorised copying, reproduction, republication, uploading, posting, transmitting, or distributing of any part of the Platform is strictly prohibited.

17.4 DATABASE RIGHTS The compilation, arrangement, and structure of the listings database and all other databases forming part of the Platform are protected by database rights under the Copyright and Rights in Databases Regulations 1997. You must not extract or re-utilise all or a substantial part of the contents of any database on the Platform without prior written consent.

17.5 DESIGN RIGHTS The visual design, look and feel, and user interface of the Platform are protected by unregistered design rights under the Copyright, Designs and Patents Act 1988 and may also be protected by registered design rights. You must not copy, imitate, or create derivative works based on the design of the Platform.

17.6 PROHIBITED ACTS Without the prior written consent of Colin Fairnie trading as Reliant Technologies, you must not: (a) copy, reproduce, republish, download, post, broadcast, transmit, or make available to the public any part of the Platform IP; (b) adapt, modify, translate, or create derivative works based on any part of the Platform IP; (c) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any software forming part of the Platform; (d) use any Drive Mart trade mark, name, logo, or domain name in any meta tag, keyword, or other hidden text or metadata; (e) use any automated tool, scraper, bot, spider, or crawler to extract data from the Platform; (f) frame, mirror, or deep-link to any part of the Platform without prior written consent; (g) register or attempt to register any trade mark, domain name, company name, or social media handle that is identical or confusingly similar to "Drive Mart" or any Drive Mart trade mark; (h) use the Drive Mart name, logo, or brand in any way that implies affiliation, endorsement, or partnership with Drive Mart without prior written consent.

17.7 USER CONTENT LICENCE By uploading, posting, or submitting any content to the Platform (including vehicle photos, descriptions, pricing, and other listing data) ("User Content"), you: (a) confirm that you own all intellectual property rights in the User Content or have obtained all necessary licences, consents, and permissions to upload it and to grant the licence below; (b) confirm that the User Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party; (c) grant Colin Fairnie trading as Reliant Technologies a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, sub-licensable licence to use, host, store, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from the User Content for the purposes of operating, improving, and promoting the Platform; (d) waive, to the fullest extent permitted by law, any moral rights you may have in the User Content in favour of Colin Fairnie trading as Reliant Technologies and its licensees. This licence survives the removal of your User Content from the Platform and the termination of your account.

17.8 INTELLECTUAL PROPERTY INFRINGEMENT NOTICES If you believe that any content on the Platform infringes your intellectual property rights, please notify us in writing at [email protected] with: (a) your full name and contact details; (b) a description of the intellectual property right you claim has been infringed; (c) a description of the content you claim is infringing and its location on the Platform; (d) a statement that you have a good faith belief that the use is not authorised; and (e) a statement that the information in your notice is accurate and that you are the rights holder or authorised to act on their behalf. We will investigate all valid notices and take appropriate action.

17.9 ENFORCEMENT Colin Fairnie trading as Reliant Technologies will actively enforce its intellectual property rights to the fullest extent of the law. Any unauthorised use of the Platform IP may result in civil proceedings for damages, an account of profits, injunctive relief, and/or criminal prosecution. Colin Fairnie trading as Reliant Technologies reserves the right to seek all available remedies in any jurisdiction.

18. Privacy & Data Protection

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Drive Mart complies with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

In connection with auctions, bidders expressly consent to their name, email address, phone number, and other contact details held on their account being shared with the seller of any auction in which they place a bid, for the purpose of facilitating completion of the transaction. This consent is given at the point of placing a bid and cannot be withdrawn in respect of bids already placed.

19. Changes to Terms

Drive Mart reserves the right to modify these Terms at any time. We will notify users of material changes via email or a prominent notice on the Platform at least 14 days before changes take effect. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform immediately.

20. Termination

Drive Mart reserves the right to suspend or terminate your access to the Platform at any time, with or without notice, for any breach of these Terms or for any other reason at our sole discretion, without liability to you. Upon termination, your right to use the Platform ceases immediately. Any listings you have posted may be removed without refund of listing fees.

The following clauses survive termination of these Terms: Clause 4 (Absolute Exclusion of Liability for Transactions), Clause 15 (Limitation of Liability), Clause 16 (Indemnity), Clause 17 (Intellectual Property), and Clause 21 (Governing Law).

21. Governing Law & Disputes

These Terms are governed by the laws of Scotland. Any disputes arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the Scottish courts.

If we cannot resolve your complaint, you may refer it to an independent dispute resolution service. Nothing in this clause prevents Colin Fairnie trading as Reliant Technologies from seeking injunctive or other equitable relief in any jurisdiction to protect its rights.

22. General

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed from the remaining Terms, which shall continue in full force and effect.

No failure or delay by Colin Fairnie trading as Reliant Technologies in exercising any right under these Terms shall constitute a waiver of that right.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Colin Fairnie trading as Reliant Technologies in relation to your use of the Platform and supersede all prior agreements, representations, and understandings.

Colin Fairnie trading as Reliant Technologies may assign its rights and obligations under these Terms without your consent. You may not assign your rights or obligations under these Terms without prior written consent.
